Terms of Use of the Parking Lot

Terms of Use of the Parking Lot

1. This parking area (hereinafter referred to as “Parking Lot”) is a private property. The compliance with the Terms of Use of the Parking Lot (hereinafter referred to as “Terms of Use”) is controlled by “Akvaparks” SIA (hereinafter referred to as “Aquapark”), registration No. 40003508890, legal address: Viestura iela 24, Jūrmala, LV-2010, Latvia.

2. The Terms of Use, based on Articles 1428, 1535 and 1537 of the Civil Law of the Republic of Latvia, are considered to be a contract concluded between absent parties. The conclusion of the contract occurs when the user of a vehicle parks his/her vehicle in the Parking Lot (the user confirms that he/she is familiar with, agrees with and fully recognizes the Terms of Use as binding).

3. Only a vehicle registered in compliance with the procedures specified by the laws and regulations and carrying proper registration plates (hereinafter referred to as “Vehicle”), is allowed to enter, stop and park in the Parking Lot. The movement, stopping and parking of a Vehicle in the Parking Lot is allowed only within marked spaces, in compliance with the Terms of Use, road traffic regulations, information signs, horizontal road markings defined by the laws and regulations of the Republic of Latvia, and without hindering the use of the Parking Lot for other users. It is forbidden to park the Vehicle in the Parking Lot for more than 48 hours from the moment of entry

4. The following vehicles are prohibited from entering, stopping and parking in the Parking Lot (except for the cases when special permits have been issued by the Aquapark):

• trucks;
• tractors;
• special equipment;
• shared vehicles (including electric scooters and scooters);

5. The parking lot can be used 24 hours a day.

6. When parking a Vehicle in the Parking Lot, the user who is not the owner (keeper) of the Vehicle confirms that he/she has received its owner’s (keeper’s) authorization to use the Vehicle and conclude contracts regarding  the use of the Vehicle, incl. agreements on the use of the Parking Lot on the Owner’s behalf.

7. The use of the Parking Lot is subject to a fee indicated by the Terms of Use:

7.1. For water park visitors (with purchased Aquapark ticket) – 1.00 EUR (fixed fee)
7.2. For other Parking users – 1.50 EUR/h from 7:00 a.m. to 11:00 p.m.
7.3. Night rate – 6.00 EUR from 11:01 p.m. to 6:59 a.m. (fixed fee)

8. The minimum payment period is 1 (one) hour.

9. Parking spaces marked with road sign 942 are intended for visitors possessing a parking card for people with disabilities. To use these parking spaces the parking fee must be paid as indicated above (see Parking fees). Places marked with road sign 942 do not grant free use of the Parking Lot.

10. Parking fees are not charged for the following vehicles:

10.1. operational transport;
10.2. vehicles with a permit granted by the Aquapark to enter the Parking area free of charge (lessee transport, delivery transport (30 minutes), employee transport (on working days of the respective employees)).

11. When entering the Parking Lot, the user of a Vehicle must collect a token from the entry terminal located in front of the entry barrier.

Payment for the Parking must be made as follows:

• For Aquapark visitors – at the Aquapark ticket office simultaneously with the purchase of the entrance ticket;
• For other users of the Parking Lot – before leaving the Parking Lot at the payment machine.

12. If the entry terminal is not working (tokens are not issued), the Vehicle user must immediately notify the Aquapark security officer or cashier.

13. Once the visit of the Aquapark (for the visitors of Aquapark) or payment period (for other users of the Parking Lot) is over, they must leave the Parking Lot within 15 minutes, throwing the paid token into the exit terminal located before the exit barrier.

14. In case of loss of the parking token, the user of a Vehicle notifies the cashier at the Aquapark ticket office about it and pays a token renewal fee of EUR 20.00 (twenty euros).

15. The user of a Vehicle is obliged to prevent any violation of the Terms of Use no later than 24 hours from the moment a violation has been detected.

16. If a Vehicle parked in the Parking Lot violates the Terms of Use by hindering the use of the Parking Lot for other users or exceeds the maximum period of continuous use of the Parking Lot, the Aquapark has the right to move the Vehicle. The costs of moving the Vehicle are covered by the owner (keeper) of the Vehicle.

17. A contractual penalty of EUR 35 (thirty-five euros) is applied for arbitrarily leaving the Parking Lot without paying for its use.

18. A contractual penalty of EUR 50 (fifty euros) is applied for arbitrarily leaving the Parking Lot without paying for its use and moving through the green area (grass) or crossing it.

19. A contractual penalty of EUR 200 (two hundred euros) is applied for arbitrarily leaving the Parking Lot without paying for its use and damaging the exit barrier or entering the Parking Lot by damaging the barrier.

20. A contractual penalty of EUR 30 (thirty euros) is applied for the violation of clauses 4 or 27 of the Terms of Use.

21. Payment of contractual penalty does not release from the obligation to compensate for damages.

22. Payment of a contractual penalty is due within 10 (ten) days from the invoice date. Once a contractual penalty has been applied, the Vehicle must leave the Parking Lot immediately.

23. The Aquapark has the right to seek recovery against the user and/or keeper and/or owner of a Vehicle for any damages caused to the Aquapark and the payment of contractual penalties arising from the parking of a Vehicle in the Parking Lot in case of violation of the Terms of Use, as well as on the basis of Articles 1735 and 1736 of the Civil Law by exercising the right of detention. The detention of the Vehicle is terminated after the payment of the applied penalty and/or compensation for damages.

24. The compliance with the Terms of Use is controlled by the Aquapark security service using technical means (incl. photo or video equipment). The photo and video recordings made by the security service shall be considered as proof of the detected violation.

25. The user of a Vehicle is responsible for the safety of his/her Vehicle. The Aquapark does not assume any responsibility for the preservation and security of the Vehicle and its contents in the Parking Lot.

26. The Aquapark is not liable for the losses incurred to the user of the Parking Lot as a result of Force Majeure.

27. If the continuous parking time of the Vehicle in the Parking lot exceeds 48 (forty-eight) hours, a prior agreement with the Aquapark is required.

28. Distributing advertising materials, goods or promoting them, installing devices that play audio advertising materials or parking trailers with advertising materials without prior agreement with the Aquapark is prohibited. A contractual penalty of EUR 500 (five hundred euros) is applicable for placing advertisements in the Parking Lot without prior approval. The Aquapark security service has the right to immediately stop such activity and expel the violator from the Parking Lot.

29. The user of the Parking Lot is prohibited from washing and/or repairing his/her vehicle in the Parking Lot or otherwise littering the territory of the Parking Lot. Smoking is allowed only in specially designated areas.

30. When needed, the Aquapark has the right to limit and also prohibit the use of the Parking Lot during its working hours.

31. The Aquapark processes the data of Vehicle owners (keepers) to ensure the performance of the contract, and stores them until the performance of the contract and until the expiration of the statute of limitations. A data subject has the right to request information about his/her data, make changes or request deletion of data, submit objections and request restriction of processing, exercise the right to data portability and file a complaint with a supervisory authority. In case of non-fulfilment of the payment obligations stipulated in the regulations, the data may be transferred to the debt recovery service providers authorized by the Aquapark.
